1. WHAT IS THE URS?

The Uniform Rapid Suspension System (URS) is a dispute resolution mechanism designed to provide trademark owners with a fast and low-cost way to suspend domain names that clearly infringe upon their intellectual property.

It is intended for "slam-dunk" cases where there is no question of bad faith and infringement.

2. URS VS. UDRP

  • URS: Results in the suspension of the domain name for the remainder of its registration period. The domain is not transferred.
  • UDRP: Results in the transfer or cancellation of the domain name. It is a more comprehensive (and more expensive) process.

3. THE URS PROCESS

3.1 Filing a Complaint

A trademark owner files a complaint with an approved URS provider (e.g., ADNDRC or FORUM) alleging that the domain name is identical or confusingly similar to their mark, that the registrant has no rights, and that the domain was registered in bad faith.

3.2 Notice and Locking

Upon receiving a valid complaint, the URS provider notifies Domanenname (via our registrar partners). We are required to "lock" the domain within 24 hours, preventing any changes to its ownership or settings.

3.3 Registrant Response

The registrant has 14 days to file a response. If no response is filed, the provider will review the case based on the complainant's evidence alone.

3.4 Determination

An examiner reviews the case. If the complainant meets the high burden of proof, the domain is suspended. If the complaint is denied, the lock is removed.

4. IMPACT ON THE DOMAIN

If a URS suspension is ordered:

  • The domain's nameservers are changed to a URS placeholder.
  • The website and email services will stop working.
  • The WHOIS record will indicate that the domain is suspended due to a URS proceeding.
  • The domain cannot be transferred or renewed by the registrant during the suspension.
